ANACORTES -- Two state agencies are asking the state Supreme Court to reconsider a recent decision that upheld Anacortes’ shoreline planning process.
The Community, Trade and Economic Development agency and the Ecology Department, who joined appellants Futurewise, Evergreen Islands and Skagit Valley Audubon Society in the case, made the announcement today.
Ecology officials say that the split decision in the Futurewise v. Anacortes case places the state agency in a role that lawmakers didn’t envision.
The July 31 ruling will have far-reaching consequences, including project delays and higher costs, according to Ecology Director Jay Manning.
The court ruled that a state law passed in 2003 meant that shoreline critical areas will be governed by shoreline master programs, rather than the Growth Management Act and critical areas ordinances.
The state agencies say the decision will create gaps in regulations protecting human health and safety. They say it will also lower environmental protection of shoreline areas and increase workload problems for local governments and state agencies.
