Couple receives maximum sentence for murder

MOUNT VERNON — A Sedro-Woolley couple received the maximum possible sentence Wednesday for the murder of a disabled and incapacitated man in October 2006.

Kenneth Ammons, 28, will serve 22 years and four months for his role in killing Herschell Rogers. His girlfriend and accomplice, Rachel Garver, 22, was sentenced to 20 years and four months. They had pleaded guilty last week to second-degree murder.

Both sentences, handed down in Skagit Superior Court, were at the top of the standard range. Ammons’ sentence was longer because he was already a convicted felon.

On Oct. 9, 2006, Ammons and Garver drove Rogers, 26, to a remote campsite north of Hamilton and crushed his skull with a hammer. Rogers was under the influence of alcohol or drugs and was unconscious during the drive and the attack.

Rogers did not speak and communicated by writing. Family members believe he also may have had mental health problems along with his drug addiction.

Garver’s lawyer presented evidence that Garver had been sexually abused since the age of 4. Superior Court Judge Michael Rickert, while sympathetic, did not show mercy in his sentencing.

“If I could get more (of a sentence) I would, but the state won’t let me,” Rickert told the defendants. A relatively recent state law restricts judges from giving exceptional sentences outside of the standard range, the judge said.

I agree that these cruel individuals deserve a longer sentence.  Sadly, nothing will bring Herschell back, or ease the pain his family and friends have been and will continue to endure.  They will remain in my thoughts and prayers.

Finally, a judge who makes the right call instead of being a wuss!  I love his quote: “If I could get more (of a sentence) I would, but the state won’t let me.” Now, that’s a man doing his job!

I think that they should have gotten life without parole. I can’t understand how they were even allowed to plea bargain. At least justice was served on this matter for Rogers family. Now they are 2 less dirtbags on the streets. Let’s just hope that the jail inmates make there lives hard for the next 20 years. They deserve what they got.

They couldn’t of had a better judge for this trial. He did what the law was set up to do find the guily ones gilty. Good job judge Rickert.

When has it been, that our community is so hast to just blurb out for just something to say, judge, or gossip about.  Obviously, the ones who have been effected the most of all, are the 3 families.  However, we can’t condone one’s actions for such a terrible crime.  Maybe it would be wise to think, we all have mental issues that could set off at anytime.  Meaning, what is the history behind one, which could create a dark individual inside.
We pray for the families, directly and in-directly involved.  As well as the community.  This is not the only crime that has ever happened, nor will it be the last to come.  We never know what is coming around the corner.  Again, we deeply give our sympathy to the one’s who are suffering the most, the families. Hopefully closure can come to all.

weareallsurvivorsinlife must be really passionate about their feelings regarding this issue as they posted the same exact response word for word in the last article about these people. Mental issues or not they had the capacity to do the crime they have the capacity to do the time.

If it were a member of your family they killed would you be so quick to pull the mental issues card?

Do you also feel this way about rapist Shaun Holt?

Well unfortunatly I am a family member to Ammons. I still feel the same, they got what they deserve. I think “weareallsurvivorsinlife” should look a little more at the big picture. They killed someone and they are going to go to hell either way. So I don’t think I am being too judgemental about this. We may all have some mental issue, but most of us know that killing someone is bad and have the self control to not do it. When they killed Mr. Rogers they gave up there right to their own lives. There were both found to be of sound mind as well. So I agree with jeepgirl would they be sympathetic if it was there family member.

I knew Herschell for many years..he was a harmless guy...he had his share of problems ,but was allways quick to smile and help others when he could...any sentence they could face will never make up for the horrible crime they comitted

To sassy and jeepgirl1975, if you re-read my comment, you will find that we feel the empathy and sympathy for the 3 families who also have fell victim in this terrible crime. Hello, stop being self-focused and give the three families your respect.  Just because Rogers’ fell victim, so did his family and ammons and garvers’ family.
Hopefully the perp’s will find God and be sorrowful of their injustice acts.  God Bless the Families.

A very important and often-overlooked point, weareallsurvivorsinlife.  Feelings tend to run pretty high in cases like this, so it’s understandable to focus on the three directly invovled and forget about their families.  Thank you for reminding us that those affected stretch far beyond the immediate.

Ammons is my cousin and I feel he got the proper punishment, but I also agree with weareallsurvivorsinlife. People overlook the families....Garvers family is affected, Rogers family and mine as well.... I do not condone what they did, but I am sad for my family as well as Garvers and Rogers… and really, the stuff some people say on here makes people no better than murderers, rapists, theives...just spewing mindless crap is as bad as some criminals. Yes what they did was wrong and horrible, but wishing the same on people like that is pretty much the same thing. I dont wish what happens to victims of rape and murder on ANYONE...even the person who did it...that makes us no better than them....

cpar332, my heart goes out to you and your family.  You’re right, people say some pretty cruel things, but I always keep in mind that it is better to be someone who SAYS terrible things than a person who DOES terrible things.  But in some cases talk IS action, so I understand your frustration.  My sympathies to you and yours during these hard times.

Thank you shrug...Like I said I in NO WAY condone what they did...it was VERY wrong. I just hope thta my family and the others can come back from all of this...it will never be forgotten and Rogers family won’t ever get him back, but I hope that they will survive and be able to “move on” (not saying forget him) not sure exactly how to phrase what I am trying to say. Again, thank you shrug...at least there are some compassionate people left in this world.

I have compassion for the victims in this matter. I just don’t have any sympathy for Ken and Rachel they got what they deserved. As for the familys it will take a lot of time to heal from this matter if it ever does heal.  I was never saying anything against the other familys involved in this. But for a few members of my family that I have discussed this with do not feel sorry for Ken. They feel sorry for Mr. Rogers family. And to saying that we are no better than the murderers themselves is crap.

It’s called an opinion for a reason it’s our right to speak what we want about issues that concern us. So saying that we are anything like a murderer, rapist or thieves is wrong. We weren’t just blurting out about this “hello he was found guilty of this horrible crime”. Why are you so sorry for the ones who did this crime? Ken came from a very large family and he is the only one who has done something like this. I am just glad that my grandpa isn’t here to have his last name known as a mureders last name as well.

I never said I felt sorry for Kenneth and Rachel....I don’t, like I said they deserved their punishment, but wishing death upon someone regardless of what they did is as bad as being a murderer,.....murder in the heart is murder in the mind, and next comes action...ifyou believe in God (for those who do, not everyone does) he wouldn’t agree with what you are saying...yes, I know they were found guilty, but popping off at the mouth and saying some of the things people are saying on here is just as bad....and like you said its called an opinion, and I have mine as well, I stated it and thats that...you stated yours and thats that. oh, and if you are talking of Robert Metzger, I agree, I’m glad he wasn’t here to see this...it would break his heart, honery old fart that he was....

I never said that I wanted them to get the death penalty, I said that they should have gotten life without parole. We are both getting out of hand on here anyway. Nothing will bring back Mr. Rogers I just hope that his family can heal from this. As for Ken and Rachel I hope they never have a day go by without thinking about what they did. And feel lucky that they still have there lives.

They have a chance for parole?!?! Well, his name is drug through the dirt as well, because that is his grandson....trust me people know...I’m just glad he isn’t here for this either.
